Delhi High Court Seeks FSSAI Response on PIL Against Misrepresentation of Non-Dairy Analogue Paneer

The petition seeks stronger inspections, sampling and lab testing to prevent dairy analogues from being sold or served as conventional paneer without proper disclosure. The court has given authorities six weeks to respond but has not ordered interim enforcement measures.

NEW DELHI— The Delhi High Court has sought responses from the Food Safety and Standards Authority of India (FSSAI), the Centre and the Delhi government on a public interest litigation (PIL) concerning the alleged sale and use of non-dairy paneer analogues without adequate disclosure to consumers.

Delhi High Court Seeks FSSAI Response on PIL Against Misrepresentation of Non-Dairy Analogue Paneer

A division bench comprising Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma granted the authorities six weeks to file their responses. The court declined to issue interim directions at this stage.

The petition was filed by law student Ridhima Singh and advocate Avlokiteshwar Padmapani Sidharth, who have called for stronger enforcement ahead of the upcoming festive season, when demand for paneer-based dishes typically rises.

PIL Seeks Stronger Surveillance and Testing

The petition asks authorities to conduct regular inspections and collect samples for laboratory testing across paneer manufacturing facilities, wholesale markets, distribution networks, retail outlets, restaurants and other food service establishments.

The petitioners contend that consumers ordering dishes such as paneer tikka, kadai paneer and paneer butter masala may reasonably expect conventional dairy paneer, without necessarily knowing whether a restaurant or cloud kitchen has substituted a non-dairy alternative.

They argue that consumers should receive clear information about a product’s actual composition and that enforcement action should be taken where food products are misrepresented or sold in violation of applicable food safety and labelling requirements.

Focus on Labelling, Not a Ban on Dairy Analogues

The PIL clarifies that it does not seek to prohibit plant-based products or dairy analogues that are manufactured and marketed legally.

Instead, it seeks to prevent such products from being represented as conventional paneer without appropriate disclosure. The distinction is significant for food manufacturers, restaurants and retailers as alternative protein ingredients and dairy substitutes enter the Indian food market.

Clear product identification and accurate menu descriptions can help consumers make informed choices while allowing businesses to market legally compliant alternatives under appropriate names and labels.

Petition Cites Actions in Other States

According to the petition, food safety authorities in Gujarat, Punjab, Chhattisgarh and Maharashtra have already taken steps concerning non-dairy paneer analogues. The petitioners have cited these measures to argue that existing regulatory provisions can support stronger enforcement in Delhi without necessarily requiring amendments to the rules.

The plea urges the Delhi government and relevant food safety authorities to strengthen monitoring mechanisms and ensure that products sold as paneer comply with applicable standards.

The specific actions reportedly taken by the other states should be assessed against their respective official orders and enforcement notices.

Implications for the Dairy and Food Service Industries

The case could bring greater attention to the distinction between conventional dairy paneer and non-dairy alternatives across the food supply chain.

For dairy processors, transparent labelling and effective enforcement are relevant to maintaining product identity and consumer confidence. For restaurants, cloud kitchens and caterers, the issue highlights the importance of accurately describing ingredients and avoiding representations that could mislead customers.

For food regulators, the challenge involves balancing consumer protection, compliance with existing food standards and the lawful sale of alternative products.

What Happens Next?

The matter will proceed after the FSSAI, the Centre and the Delhi government submit their responses within the period granted by the court. As of the reported hearing on October 14, no interim enforcement order had been issued.

The case therefore remains at the response stage. The petitioners’ allegations and requests for directions should not be treated as final judicial findings.
