NEW DELHI: The Food Safety and Standards Authority of India (FSSAI) has initiated legal proceedings against Nestle India Ltd over alleged non-compliance with food-safety and promotional requirements involving three infant nutrition products, the regulator said.
According to FSSAI, the products examined were NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula manufactured by Nestle India. The regulator also reviewed promotional material for the products available on e-commerce platforms.
FSSAI Flags Promotional Claims
During its examination, FSSAI flagged claims associated with “5HMOs” and “Whey Protein” in promotional material for NAN Excella Pro Stage 1.
For Lactogen Pro 1, the regulator cited promotional material describing “Whey Protein” as easy to digest.
FSSAI said the claims for the two products were found to be in contravention of Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, which restricts promotional claims or material intended to increase the saleability of infant foods.

The regulator also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, which places restrictions on the advertisement and promotion of such products.
Follow-Up Formula Fails Biotin Requirement
Separately, FSSAI said a sample of a Nestle India follow-up formula was found to be substandard for its Biotin content during laboratory analysis.
The sample was subsequently sent for re-analysis. According to FSSAI, the referral laboratory also found the sample non-conforming with the Biotin requirement prescribed under the 2020 regulations.
Three Adjudication Cases Filed
Based on these findings, FSSAI said it has filed three separate adjudication cases against Nestle India, relating to the three products.
The proceedings will determine the regulatory consequences of the alleged violations. The initiation of adjudication proceedings should be distinguished from a final finding of liability by the competent authority.
Nestle India Shares Decline
The regulatory development also coincided with a decline in Nestle India’s share price.
At 1:10 pm, shares of Nestle India were reported to be down nearly 2% at ₹1,345.45 on the BSE.
The proceedings come amid continued regulatory scrutiny of infant nutrition products, particularly regarding product composition, laboratory compliance and restrictions on the promotion and marketing of infant foods.
