New Delhi : A sample of Nestlé India’s low-fat dairy whitener, collected from The LaLiT hotel in New Delhi, has been declared “unsafe” and “substandard” following laboratory analysis, according to the Food Safety and Standards Authority of India (FSSAI).

The food safety regulator said in a post on X that laboratory testing found the sample non-compliant with applicable requirements. Authorities have directed the hotel to immediately stop selling the product.

FSSAI has not publicly released the complete laboratory report detailing the test findings.

Nestlé Disputes the Finding

Nestlé India has disputed the regulator’s assessment, maintaining that the dairy whitener is safe for consumption and compliant with applicable regulations.

According to the company, the FSSAI assessment compared the product’s total phosphorus content with the regulatory limit for added phosphorus without accounting for phosphorus that naturally occurs in milk-based ingredients.

A Nestlé spokesperson said the company is engaging with the authorities and has provided data on the product and similar milk-based products to demonstrate the presence of naturally occurring phosphorus.

FSSAI had not immediately responded to requests for comment on Nestlé India’s explanation, while The LaLiT hotel also did not respond to requests for comment.

Full Laboratory Findings Not Public

The development leaves the regulatory finding and the company’s technical objection at the centre of the dispute. Until the complete laboratory report and any subsequent regulatory or adjudicatory findings are made public, the precise basis of the “unsafe” and “substandard” classification cannot be independently assessed from the information currently available.

The case highlights the importance of transparent laboratory findings and clear interpretation of compositional standards when assessing milk-based food products.

Earlier Regulatory Action Involving Nestlé

The latest development follows another regulatory dispute involving Nestlé in India.

In September, FSSAI said it had found a Nestlé baby-food sample to be substandard and was pursuing legal action against the company.

Nestlé had responded at the time by stating that its products were fully compliant with applicable regulations.

The latest dairy-whitener case is therefore another instance in which a regulatory finding has been followed by a technical challenge from the company, with further proceedings expected to determine the matter.
